With a second offense, both the fines and prison sentences may increase. Any additional convictions and the person risks a license revocation and the loss of the ability to drive for life. A judge may also order the defendant to participate in drug or alcohol treatment and education programs. If an auto accident occurred with the DWI, the offender may face civil charges with additional repercussions.
Under the age of 21?
While those over 21 can be charged with DWI if their blood alcohol level is above a certain percentage (0.08% in Texas), if anyone under the age of 21 is found to have any detectable alcohol in their system at all, they will immediately be charged with DUI or Driving Under the Influence with zero tolerance. The amount of alcohol in their system determines the penalties they will face. If a person under 21 is found intoxicated, he or she will incur the same repercussions as an adult.
